This Privacy Policy explains how POND USA, POND, we, us, or our collects, uses, discloses, retains, and protects information when you use the POND app, compatible POND devices, our website, and related services.

By using the POND app or services, you acknowledge that your information will be handled as described in this Privacy Policy.

Account and Profile Information

We may collect information you provide when creating or managing an account, including name, username, email address, phone number if provided or required for a feature, account settings, profile fields, email verification status, two-factor authentication status, support messages, and related contact information.

To keep your account secure and support login features, we may process access tokens, refresh tokens, email verification tokens, password reset tokens, pending two-factor authentication tokens, Google Sign-In identity tokens if you choose Google Sign-In, and Apple identity tokens if you choose Sign in with Apple.

Authentication tokens are used to verify your account and should not be shared with others.

Connected Device Information

When you connect, provision, bind, control, or monitor a compatible POND device, we may collect or process POND device identifiers, Bluetooth or nearby-device identifiers, MAC address or hardware identifier where available, firmware version, device name, pairing and binding status, online or offline state, and Wi-Fi provisioning status.

We may also collect or process winding configuration, LED and ambience settings, device schedules, watch assignment settings, activity logs, telemetry, diagnostics, device commands, and firmware update status.

This information is used to provide device setup, control, monitoring, troubleshooting, security, support, reliability, and firmware update features.

Bluetooth, Nearby Devices, and Wi-Fi Setup

The app uses Bluetooth or nearby-device access to discover, connect to, provision, and control compatible POND hardware.

During setup, Wi-Fi network information you provide may be transmitted locally from your phone to your POND device so the device can connect to your network.

POND does not use Bluetooth permission to track your physical location. On Android, location permission may be requested where Android requires it for Bluetooth or nearby-device scanning behavior. POND does not collect or store precise GPS location through the app.

Watch Profiles and Images

If you use watch collection features, we may collect or process watch brand or manufacturer, watch model, recommended turns per day, winding direction, wind and rest timing, notes, collection preferences, and watch-to-device assignments.

If you choose to add profile images or watch images, the app may request access to your camera or photo library. Camera and photo library access is used only when you choose to add or update an image.

Selected profile or watch images are stored locally on your device. POND does not upload those images to cloud storage as part of the current app and website services.

Commerce Information

Where shopping or checkout features are available on official POND channels, commerce flows are powered by Shopify or related checkout and payment providers.

Commerce information may include product information, cart contents, checkout URL, product variants, discounts, totals, shipping, tax, order-related information, and buyer identity information where used for checkout.

Payment card information is entered through official checkout or payment-provider flows. POND does not directly collect full payment card details.

Support, Technical, and Service Information

If you contact us for support, we may collect your name and contact information, account or device identifiers needed to troubleshoot, messages and attachments you provide, support history, and diagnostic information relevant to your request.

We may collect technical information needed to operate, secure, debug, and improve the service, such as app version, device model and operating system, network request metadata, server logs, error information, security events, rate-limit and abuse-prevention data, and backend API activity needed to provide the service.

On the website, we collect waitlist form details you submit, including name, email address, country, city, collection profile, optional launch note, update preference, and security verification data needed to protect the form from spam and abuse.

How We Use Information

We use information to create, verify, secure, and manage accounts; authenticate users; provide Google Sign-In and Sign in with Apple when selected; provide two-factor authentication and password reset flows; and maintain app and backend security.

We use information to discover, connect, provision, bind, monitor, troubleshoot, and control POND devices; store and sync watch profiles, device schedules, winding settings, preferences, telemetry, and activity history; provide firmware update and reliability features; and provide realtime device updates.

We use information to provide support, respond to user requests, send service messages, security notices, setup confirmations, support replies, and optional notifications where available.

We use information to power product browsing, cart, checkout, purchase support, and order-related experiences; prevent misuse, fraud, abuse, and unauthorized access; diagnose bugs and improve reliability; and comply with legal, tax, accounting, warranty, dispute-resolution, and compliance obligations.

Permissions

Bluetooth and nearby-device permissions are used to discover, connect to, provision, and control compatible POND hardware.

Android may require location permission for Bluetooth or nearby-device scanning. POND does not use this permission to collect or store precise GPS location.

Camera permission is used only when you choose to take a photo for a profile or watch image. Photo library permission is used only when you choose to select an image from your device.

Network access is used for account authentication, backend API communication, realtime device updates, support, and commerce experiences. If notification features are enabled, notifications may be used for service updates, device status, security messages, or user-selected alerts.

Cookies, Analytics, and Similar Technologies

POND uses necessary technologies for security, abuse prevention, storing cookie choices, and operating requested site features. The waitlist page may load Cloudflare Turnstile as a necessary security technology before form submission.

The current website code does not install Google Analytics, Meta Pixel, or similar third-party analytics or advertising tags by default. Optional analytics and marketing tools remain blocked unless you grant the relevant consent.

Sharing and Service Providers

We do not sell personal information.

We may share information with service providers that help us operate the app, devices, backend, support, authentication, storage, hosting, commerce, security, diagnostics, and legal or compliance workflows.

These providers may include cloud hosting and backend infrastructure providers, authentication providers, Google when you choose Google Sign-In, Apple when you choose Sign in with Apple, Shopify and related commerce or payment providers where checkout is used, app stores and platform providers, email and support providers, security and fraud-prevention providers, Cloudflare for waitlist form protection, legal, accounting, tax, warranty, and compliance providers. No third-party analytics or advertising provider is active by default on the current website.

Third-party services may process information under their own terms and privacy policies. We may also disclose information if required to comply with law, enforce our terms, protect rights and safety, investigate fraud or abuse, respond to lawful requests, or complete a business transaction such as a merger, acquisition, financing, or sale of assets.

Data Retention

We keep account and device information while your account is active and as needed to provide the service.

We may retain certain information for longer where necessary for security, fraud prevention, legal obligations, accounting and tax records, warranty records, dispute resolution, compliance, backup and disaster recovery, or enforcing agreements.

Locally stored images, preferences, and cached data may remain on your device until you remove them, delete the app, or clear app data.

Account and Data Deletion

If you create an account in the POND app, you can request account deletion from within the app or through our public account deletion page at https://pondwinder.com/account-deletion/.

When we delete an account, we delete or de-identify account data associated with that account unless retention is legally or operationally required. Some information may be retained where necessary for security, fraud prevention, legal, accounting, warranty, tax, dispute-resolution, compliance, or legitimate backup purposes.

Deleting your app account may affect your ability to control connected POND devices through the app. Locally stored information may remain on your device until you remove it, delete the app, or clear app data.

Security

We use reasonable safeguards designed to protect information, including encrypted transport for server communication and secure token storage on supported devices.

However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

You are responsible for keeping your account credentials secure and for notifying us if you believe your account has been compromised.

Children and International Processing

The POND app and services are not intended for children under the minimum age required by applicable law. We do not knowingly collect personal information from children where parental consent is required. Information may be processed in countries other than where you live. Where required, we use safeguards designed to protect information according to applicable law.

Changes and Contact

We may update this Privacy Policy from time to time. When we update it, we will post the revised version with a new effective date. If changes are material, we may provide additional notice where required by law.
